1. Data controller
KOLD GOLD, S.A.P.I. de C.V. (“Kold Gold”), with its address at Av. Jesús del Monte 47, Int. A-401, Huixquilucan, Estado de México, C.P. 52764, is responsible for processing your personal data. Privacy contact: direccion@kold.gold.
2. Data we process
- Identification and contact details: name, email address, phone number, and job title.
- Information about your business: trade name, legal name, industry, services, prices, hours, links, and social media.
- Billing and payment details: tax information for your invoice and your payment method. Your card details are collected and stored by the payment processor; Kold Gold does not store them.
- Files you share with us, such as your logo.
We do not request sensitive personal data. Please do not include it in the form or in the chat.
3. Primary purposes
Necessary for the relationship you request: evaluating your application; preparing your proposal; creating and configuring your AI agency workspace; contacting you about your onboarding; invoicing and billing.
4. Secondary purposes
Sending you Kold Gold news and content. You may opt out without affecting the service by emailing direccion@kold.gold with the subject line “Do not send news,” or by using the unsubscribe link included in every message.
Measuring visits to the site and the results of our campaigns with Google Analytics 4, only if you accept it in the site's cookie notice (section 9). You may refuse or withdraw your consent at any time without affecting the service.
5. Artificial intelligence and automated decisions
We use AI tools to organize your information and prepare your agency's configuration. Decisions about your onboarding are made by a person. You may object to automated processing and ask for a person to review your case.
6. Processors and transfers
To provide the service, we share data with providers acting on our behalf (processors): CRM, forms, and messaging (HighLevel / LeadConnector); payment processor (Stripe); website hosting and database (Vercel, Hostinger, and Supabase); email and productivity (Google Workspace); telephony, voice, and AI model providers; and, only when you connect those channels, messaging providers such as WhatsApp Business (Meta). Some are located outside Mexico. Only if you accept the site's analytics, Google LLC, in the United States, also receives the browsing data described in section 9 and processes it on our behalf (Google Analytics 4). Sharing data with these processors, which handle it on our behalf, is not a transfer to third parties. We do not sell your data or make transfers to third parties that require your consent; if we ever did so in the future, we would inform you beforehand and ask for your consent.
When we set up an AI agency for your business, you are the controller of your customers' data and Kold Gold processes it as a processor, under the data processing agreement we sign.
7. ARCO rights and right to object
Under Mexican data protection law (LFPDPPP), you may request access to, rectification, cancellation of, or object to the processing of your data (ARCO rights) by emailing direccion@kold.gold with: your name and a way to reply to you; a copy of your ID (or proof of your representative's authority); a clear description of the data and the right you are exercising; and, where applicable, any documents supporting your request. We will notify you of our response within a maximum of 20 business days from the date we receive your request and, if applicable, carry it out within the following 15 business days. Each of these periods may be extended once, for an equal period, when the circumstances of the case justify it.
8. Withdrawal of consent and limiting use
You may withdraw your consent or ask us to limit the use or disclosure of your data through the same channel described in section 7. Withdrawal is not retroactive and may prevent us from continuing to provide the service.
9. Cookies and tracking technologies
This site has no advertising pixels from Meta or Google configured. Its own code saves your language preference and your analytics choice in your browser (local storage).
Google Analytics 4, only with your consent. On your first visit we show you a cookie notice with two options: “Accept analytics” and “Reject.” Until you accept, the site does not load Google Analytics, does not set its cookies, and sends no data to Google. If you accept, Google Analytics 4 sets the _ga and _ga_<ID> cookies (they last up to 13 months) and records, linked to a random identifier: the pages you visit, the referring page, the campaign parameters in the link (UTM), the date and time, your approximate location (country and city, derived from your IP address, which Google Analytics does not store), your device type, operating system, browser, language, screen resolution, and some interactions, such as scrolling and clicks on external links. The purpose is to measure visits to the site and the results of our campaigns; we do not use this data to identify you or to make decisions about you, and advertising, Google signals, and ad personalization are turned off. This involves a transfer of data to Google LLC, in the United States, which processes it on our behalf under its data processing terms. Event data is kept in Google Analytics for up to 14 months, according to our property's retention setting, and is then deleted; aggregated reports, which do not identify anyone, may be kept longer.
You can reject analytics or withdraw your consent at any time with the “Cookie preferences” link at the bottom of every page: when you choose “Reject,” the site stops sending data to Google Analytics and deletes its cookies. You can also delete cookies and site data in your browser or install the Google Analytics opt-out browser add-on. Rejecting does not affect your use of the site.
The site chat and the sign-up form are embedded tools from our CRM platform (HighLevel / LeadConnector). Those tools do use tracking technologies of their own: they save a session identifier and a history of the pages you visit on this site in your browser (local storage), and they record each visit in our CRM account (page visited, referring page, campaign parameters in the link, and date and time) in order to keep your conversation going and to know how you reached the site; their network (Cloudflare) also sets a short-lived security cookie. The sign-up form includes a bot check (Cloudflare Turnstile) and downloads the Meta pixel library that is built into the platform; Kold Gold has no pixel configured in it, but your browser still connects to Meta's servers to download it. Fonts are loaded from Google Fonts and Bunny Fonts, so your browser connects to those servers to download them. You can block or delete cookies and site data in your browser's privacy settings; if you do, the chat or the form may not work properly. If we configure advertising pixels or other measurement tools in the future, we will update this notice before turning them on.
10. Authority
If you believe your right to data protection has been violated, you may contact Mexico's Secretaría Anticorrupción y Buen Gobierno (Ministry of Anti-Corruption and Good Governance), which is the competent authority for the protection of personal data held by private parties. Its current contact details are published on its official website at gob.mx.
11. Changes to this notice
We will publish any changes at agentes.kold.gold/privacidad.
